Common questions about personal injury

The insurance companies want to get you to settle for the least amount possible as quickly as possible. The reason they do this is because they know that not all of the bills come right away. They may pay the hospital bill but they don’t give you a chance to seek further treatment or receive all the associated bills. We’re on your side and our goal is to settle for the highest amount possible. We know what it takes to shore up your case for the best results. It’s all in the details. Most attorneys try hard but don’t know the medical side of the case. Here at Ramji Law Group, we know the medical aspects and understand what documentation and testing the insurance company needs to make a fair decision on your claim. We can catch issues that other firms just can’t.
In short… nothing. It may cost you money to hire another attorney who wants a retainer fee and will charge you per hour even if you don’t win. Here at Ramji Law Group we work on a simple plan: If you don’t get paid, we don’t get paid. So you know we are working our hardest to get you the most from what you deserve.
It’s true. Adam Ramji was first a chiropractor dealing with many car accident victims recover from their injuries. He saw a need decided to work on the other side as an attorney. After much hard work, he graduated from law school and opened his own firm to help injured victims fight for what they deserve. His medical expertise gives him a great advantage when dealing with the insurance companies, their adjusters and defense attorneys. He has never sent a bill to a client. When the time comes to disburse your settlement, we will work hard to pay all of your medical bills and you walk away with a settlement for pain and suffering.
We have absolutely no issue meeting you in the hospital, at home or at work if you are unable to come in to our office. We will do whatever it takes to help you get the treatment you need to get well.
Every case is different. Simply put, the settlement is based on your injuries and treatment. Insurance companies evaluate the accident severity and the necessary medical treatment that follows to determine how much they will offer. Additionally, the amount of your medical bills and the policy limits on the case play a large role in the settlement amount. That being said, there is no way to tell what your case is worth until you have completed treatment.
There is no straight forward answer to that question. It depends on the nature of the injuries, the rehabilitation time and also the insurance company response time. We can go further into detail once we know the facts about your case.
We make every effort to settle the case for a fair amount without filing a law suit. Sometimes, however, if the insurance company is being unfair or refuses to accept liability, we will file a law suit and one of our very qualified attorneys will fight your case.
This will depend on the type of insurance you have. Only a “comprehensive” car insurance policy will cover damage to your vehicle due to a hurricane, and even that would not cover personal items within, but not affixed to, the vehicle according to the Texas Department of Insurance (TDI). Click here to visit TDI’s website for more information on the coverage offered by different types of car insurance policies.
The Houston Chronicle reports that most rental insurance policies will not cover damage caused by Hurricane flooding. Click here for more information on the specific ways in which renters may be affected by Hurricane Harvey.
According to the Texas Department of Insurance (TDI), most homeowner’s insurance policies do not cover damages caused by flooding, and it will be challenging to get coverage for such damage without a specific flood insurance policy through National Flood Insurance Program. Nevertheless, most homeowner’s insurance policies do cover damages caused by hurricane winds, so it is possible that you will be able to recover for water-related property damage if you can prove that wind allowed water to seep in and damage property where it otherwise, would not have. Because it can be difficult to pinpoint the source of water damage in any storm, particularly a storm as devastating as Hurricane Harvey, these types of insurance claims can become contentious, but it is important to know that this option is available. Click here to visit TDI’s website for more information on the variety of insurance policies available to homeowners in Texas.
Despite the attention it has garnered, Texas House Bill 1774 will only have an impact on a small number of Hurricane Harvey related claims filed after August 31, 2017. Not only does the law not apply to insurance claims under the National Flood Insurance Program, but it will only have an impact on a small number of those private insurance claims that are delayed, disputed or result in litigation. See this reporting by Vox for more information on Texas House Bill 1774.
Individuals and families can apply for FEMA assistance for property damages not covered by insurance, including temporary housing and relocation. Also, the Small Business Administration offers disaster loan assistance to businesses, nonprofits, homeowners, and renters. Click the links for more information and to fill out an application.
While it may be possible to recover for personal injuries or a wrongful death caused by the city or state’s negligence in responding to an emergency call, the mere delay in response, however lengthy, is not a sufficient basis for liability in Texas (SeeFernandez v. City of El Paso, 876 S.W.2d 370 `{`8th Dist. 1993`}`).
PIP stand for Personal Injury Protection. It is a 1st party claim. Which means, it is a coverage that protects the driver and passengers in your car. It does NOT go to anyone else. Again, it is ONLY for the driver and passengers in your car. So if someone hits you, and the accident is NOT your fault, you can claim your PIP. If YOU hit someone, and the accident IS your fault….you can STILL claim PIP. Because it is “no fault” coverage. It doesn’t matter who is at fault.
PIP is typically sold in 3 increments. $2,500, $5,000, and $10,000 coverage. Each increment is avail to each person in the car. So if you and your spouse and your kid are in the car, and you have $2,500 of coverage, then EACH person can claim $2,500, a total of $7,500. Now for a few dollars more per year, you can get the $10,000 coverage. So in the same example, each person can claim $10,000, a total of $30,000! Yes, there is a HUGE difference. So always get the $10,000.
PIP payment goes towards 4 things: 1. Funeral expenses related to the accident (we hope you don’t fall in this category). 2. Any hired domestic help. Help you need with laundry, the garden, etc., because you are injured and cannot do it yourself. 3. 80% of lost wages due to this accident. 4. Medical expenses that arise from this accident.
