Every case is different. Simply put, the settlement is based on your injuries and treatment. Insurance companies evaluate the accident severity and the necessary medical treatment that follows to determine how much they will offer. Additionally, the amount of your medical bills and the policy limits on the case play a large role in the settlement amount. That being said, there is no way to tell what your case is worth until you have completed treatment.

This will depend on the type of insurance you have. Only a “comprehensive” car insurance policy will cover damage to your vehicle due to a hurricane, and even that would not cover personal items within, but not affixed to, the vehicle according to the Texas Department of Insurance (TDI). According to the Texas Department of Insurance (TDI), most homeowner’s insurance policies do not cover damages caused by flooding, and it will be challenging to get coverage for such damage without a specific flood insurance policy through National Flood Insurance Program. Nevertheless, most homeowner’s insurance policies do cover damages caused by hurricane winds, so it is possible that you will be able to recover for water-related property damage if you can prove that wind allowed water to seep in and damage property where it otherwise, would not have. Because it can be difficult to pinpoint the source of water damage in any storm, particularly a storm as devastating as Hurricane Harvey, these types of insurance claims can become contentious, but it is important to know that this option is available. Despite the attention it has garnered, Texas House Bill 1774 will only have an impact on a small number of Hurricane Harvey related claims filed after August 31, 2017. Not only does the law not apply to insurance claims under the National Flood Insurance Program, but it will only have an impact on a small number of those private insurance claims that are delayed, disputed or result in litigation. Individuals and families can apply for FEMA assistance for property damages not covered by insurance, including temporary housing and relocation. While it may be possible to recover for personal injuries or a wrongful death caused by the city or state’s negligence in responding to an emergency call, the mere delay in response, however lengthy, is not a sufficient basis for liability in Texas (SeeFernandez v. City of El Paso, 876 S.W.2d 370 `{`8th Dist. 1993`}`).
PIP stand for Personal Injury Protection. It is a 1st party claim. Which means, it is a coverage that protects the driver and passengers in your car. It does NOT go to anyone else. Again, it is ONLY for the driver and passengers in your car. So if someone hits you, and the accident is NOT your fault, you can claim your PIP. If YOU hit someone, and the accident IS your fault….you can STILL claim PIP. Because it is “no fault” coverage. It doesn’t matter who is at fault.
PIP is typically sold in 3 increments. $2,500, $5,000, and $10,000 coverage. Each increment is avail to each person in the car. So if you and your spouse and your kid are in the car, and you have $2,500 of coverage, then EACH person can claim $2,500, a total of $7,500. Now for a few dollars more per year, you can get the $10,000 coverage. So in the same example, each person can claim $10,000, a total of $30,000! Yes, there is a HUGE difference. So always get the $10,000.
PIP payment goes towards 4 things: 1. Funeral expenses related to the accident (we hope you don’t fall in this category). 2. Any hired domestic help. Help you need with laundry, the garden, etc., because you are injured and cannot do it yourself. 3. 80% of lost wages due to this accident. 4. Medical expenses that arise from this accident.
